Clenergise 2 is a device cloud monitoring platform (the "Platform"). The Platform is provided by Clenergy Technology Co., Ltd (registered at No. 1001, 1003, 1005, 1007, 1009 Minan Road, Xiang'an District, Xiamen, Fujian, PR China) and is made available to users in Australia by KERRYJ INVESTMENT PTY LTD (ABN 73 108 633 227, ACN 108 633 227) trading as Clenergy Australia, of Warehouse 3/10 Duerdin Street, Clayton, Victoria 3168, Australia (together with their affiliates and subsidiaries, "Clenergy", "we", "us" or "our"). This Policy forms an integral part of the Clenergise User Terms; if any inconsistency exists, the specific provision shall prevail. For the personal information we collect through the Platform, Clenergy acts as the controller. This Privacy Policy explains what information we collect, how we use it, how and with whom we share it, how we protect it, and the rights and choices you have.
To provide you with the full functionality of the Platform and with quality after-sales and operation & maintenance (O&M) service, we use your information and share it with our partners — device manufacturers, installers and distributors, our affiliates and subsidiaries, and third-party service providers (together, our "Partners"). We give you controls to see and manage this sharing, and we protect your information with appropriate technical and organisational safeguards. The main points are:
We comply with the data-protection laws that apply to you based on your location.
While you use the Platform, we collect necessary personal information, non-necessary personal information and sensitive personal information and use the information you actively provide and the information generated through your use of the Services, as follows.
When you register, we collect and use your name, mobile phone number or email address, and login credentials, to create your account and protect its security. You may also choose to provide a username and other optional information. If you do not provide the required information, you may not be able to use our Services normally.
To operate the Services, optimize the user experience and protect your account, we collect basic technical information such as device model, operating system, unique device identifier, login IP address, MAC address, Clenergise 2 version, network connection type and status, operation logs and service logs (such as your searches and views in Clenergise, service failures and referral URLs). We will not collect irrelevant technical data without justification.
When you use the monitoring function, we collect the serial numbers (SN) of the data logger and its sub-devices (such as inverters and meters), and our monitoring system collects the data uploaded by these devices at regular intervals (for example, every five minutes) to provide statistics and analysis. To provide timely support and fault diagnosis, we also collect telemetry such as device serial number, device status and alarm codes, which may be used by the relevant device manufacturer to diagnose faults. We will not use such device data for other commercial purposes without your additional consent.
When you/installer creates a plant, you/installer enters information such as plant name, region, capacity, address and GPS location. This is uploaded and stored on our servers so you can access it from other devices, and you can modify it at any time. During device network configuration, any passwords stored are using irreversible encryption.
When you contact customer service, we may ask you to provide information needed to verify your identity and protect your account, and we may keep your contact details and the record and content of your communications with us, so that we can provide and record support. We use this information only within the necessary scope.
To provide certain features we may request device permissions such as camera (to scan and identify a data logger), location (to create a plant or to launch navigation to a plant) and phone (to dial a contact number from within the app). Sensitive permissions are not enabled by default; we use them only within the scope of your consent and only while you use the related feature. You can review and manage the permissions you have granted at any time through your device settings or the in-app settings. Revoking any permissions will disable the corresponding function.
To keep the Services secure and understand how the Platform performs, we may log information such as how often you use the app, crash data, overall usage and performance data, and use data such as unique device identifiers, login IP addresses, operation logs and location information to detect and prevent fraud, account theft and other unlawful acts and to carry out security checks. We do not merge analytics data with personally identifiable information you provide in the app.
Where permitted by applicable law, we may collect and use your personal information without your consent — for example, where necessary to comply with a legal obligation, to protect public safety or a major public interest, or where you have made the information public yourself. If we wish to use your personal information for a purpose beyond what you authorized, we will inform you and obtain your consent before doing so.
Where applicable law requires a legal basis, we process your personal information on one or more of the following legal bases: performance of our contract with you (to provide the Services); your consent (which you may withdraw at any time); our legitimate interests (such as operating, securing and improving the Platform and providing after-sales and O&M service through our Partners), balanced against your rights; and compliance with our legal obligations.
To keep the website and app working properly and efficiently, we store small data files called cookies on your browser or device. Cookies help you avoid repeatedly filling in information and remember your preferences. You can manage or delete cookies and clear cached data in your browser or device settings, although some convenience and security features may then be unavailable.
We use your information to provide, operate, secure, support and improve the Services and to develop new products and services. To do this, and to provide you with quality after-sales and O&M service, we share your information with our Partners as set out below. Where we share your information, we require the recipient to protect it consistently with this Privacy Policy and applicable law.
So that device manufacturers and their installers and distributors can provide after-sales service and operation & maintenance, they can access your plant through device-library and product functions, on a read-only basis. The authorization information for a plant includes personal information (name, phone number and email address, where available) and device information.
This access is enabled by default so you can receive timely service, but you remain in control. Through the Platform's plant authorization settings, you can see which device manufacturers and distributors are authorized, remove any of them, or restrict access so that businesses cannot access your plant unless you actively authorize them. See Section 7.
As a global group, we may share your personal information with Clenergy affiliates and subsidiaries to operate and support the Platform and provide the Services, subject to this Privacy Policy.
To deliver and improve the Services, we engage third-party service providers — for example cloud hosting, data analytics, messaging/push notifications and AI service providers. These providers act as our processors, may access personal information only to perform services on our instructions, and are contractually required to protect it and comply with applicable data-protection law. To deliver push notifications we may share limited data (such as device identifier, country/region and language settings) with push providers (for example, Google Firebase Cloud Messaging for Android and the Apple Push Notification service for iOS); you can manage push preferences in your device settings.
We may disclose your information where we believe in good faith it is necessary to comply with the law or a request from a court, law-enforcement or government authority, to enforce our terms, or to prevent physical harm, financial loss or unlawful activity.
If Clenergy is involved in a merger, division, acquisition, reorganization or similar transaction that involves a transfer of personal information, we will inform you of the relevant circumstances and require the recipient to continue to protect your personal information in accordance with this Privacy Policy.
We may use and share aggregated, anonymized or de-identified information that does not identify you, for purposes including statistics, research, product improvement and business analysis. Such information is not treated as personal information.
We use artificial intelligence to operate and improve the Services and to help you use our products more effectively — for example, to detect faults, generate performance insights and recommend the most efficient ways to configure and run your plant. We may also use the data under your account (including device, plant and telemetry data and related personal information) to develop, train and improve our AI models. As between you and us, this data belongs to Clenergy and forms part of operating and improving the Services.
Before you use the Platform you are asked to read this Privacy Policy and the User Terms and to confirm that you have read and agree to them; by giving that confirmation you consent to our use of your data for the AI purposes described above. We protect your privacy when we do this: we apply appropriate security safeguards, use de-identified or aggregated data where possible, require our AI service providers to act only on our instructions (see Section 3.3), and do not disclose your personal information through these models.
We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing. If we introduce any such decision-making in future, we will tell you and, where applicable law provides, give you the right to obtain human review of the decision (see Section 7).
Clenergy operates globally, and your personal information may be transferred to, stored in and processed in countries other than your own — including by our affiliates, Partners and service providers — which may have different data-protection laws. Where we transfer personal information to a country that may not provide the same level of protection as your own, we apply appropriate safeguards as required by applicable law, together with additional measures where necessary.
We keep your personal information only for as long as necessary to fulfil the purposes described in this Policy or as required by law. For example, the phone number or email linked to your account is kept while you use the Services and deleted when you delete your account; plant information is deleted when you delete the corresponding plant. If we discontinue the Platform, we will notify you and delete or anonymise your personal information within a reasonable period.
By using the Platform, you acknowledge and consent to such international data transfers. You may withdraw your consent at any time, which may cause partial functions to be unavailable.
We are committed to protecting your information against theft, misuse, unauthorised access and leakage. We use reasonable security measures such as encryption (for example SSL/TLS), de-identification and anonymisation, restrict access to authorised personnel who are bound by confidentiality obligations, and maintain management policies, processes and teams for information security. In the event of a personal information security incident, we will respond promptly, notify you and the competent authority where required by law, and tell you the measures taken and the steps you can take. No security measure is perfect, and we cannot guarantee that our measures will eliminate all security risks. You are responsible for keeping your account credentials, including your password, secure and confidential.
The Platform is intended for adults. We do not knowingly collect personal information from children under 16, and you must be 16 or older (or the minimum age required by your local law) to create an account. If we learn that we have collected a child's personal information without appropriate consent, we will delete it as soon as possible. Minors shall not register or use the Platform independently.
Subject to applicable law, you have the following rights over your personal information. You can exercise them through the settings available in the Platform, or by contacting us using the details in Section 9.
You may receive content or links from third parties other than Clenergy and its Partners. We do not control those third parties and are not responsible for their privacy practices. Please read the relevant third party's privacy policy before submitting personal information to them.
Where Clenergy offers participation in a virtual power plant (VPP) or energy-trading program through a third-party provider or aggregator as a default or standard part of your offering, we will tell you before you are enrolled and explain how we protect your privacy in that program. We share this information with the VPP provider or aggregator only to enable the service, and we require them to protect it consistently with this Privacy Policy and applicable law.
If you choose to subscribe to a third-party VPP or energy-trading platform directly (for example AGL or Amber), that provider is responsible for its own collection and use of your information under its own terms and privacy policy. Clenergy is not responsible for the privacy practices of those third parties, and you should read their privacy policy before subscribing.
We may update this Privacy Policy from time to time. We will provide the updated policy by push notification, pop-up or other means when you log in or when the app is updated, and the "Last updated" date above will change.

You also have the right to lodge a complaint with your local data-protection supervisory authority.
We will respond within 30 working days of receiving your request or complaint. Where a matter is complex, the period for completing our handling will generally not exceed 90 days, and we will inform you of the timeframe and reasons for any delay. Any dispute arising from this Policy shall be governed by the applicable laws specified in the Clenergise 2 User Term.
